UNCONTESTED DIVORCE AGREEMENT

The agreement below is made for the uncontested divorce of PLEASE ENTER YOUR NAME IN FULL and PLEASE ENTER YOUR SPOUSE’S NAME IN FULL according to Article 166/3 of the Turkish Civil Code.

  1. Parties mutually agreed to divorce in uncontested manner with their free will. To enable this PLEASE ENTER HIS/HER NAME IN FULL will apply to the competent court in Turkey and PLEASE ENTER HIS/HER NAME IN FULL will accept the application for divorce.
  2. After the divorce is granted (degree absolute) PLEASE ENTER HIS/HER NAME IN FULL agrees to pay ….00TL alimony for the benefit of PLEASE ENTER HIS/HER NAME IN FULL to the following bank account: PLEASE ENTER BANK ACCOUNT DETAILS.
  3. The custody of child in common PLEASE ENTER YOUR CHILD’S NAME IN FULL born on …/…/….. is entrusted to the mother PLEASE ENTER HIS/HER NAME IN FULL. Father PLEASE ENTER HIS NAME IN  FULL agrees to pay ….00TL to the same account above as “child support allowance”  for the benefit of the child in common PLEASE ENTER YOUR CHILD’S NAME IN FULL.
  4. Alimony and the child suppport allowance payments mentioned above shall start after the first month of the date of the decree absolute and will be payable in the firts week of each month. Father PLEASE ENTER HIS NAME IN FULL agrees to increase both payments 2% each year.
  5. Personal relationship between Father PLEASE ENTER HIS NAME IN FULL and child in common PLEASE ENTER YOUR CHILD’S NAME IN FULL shall be maintained as follows:
    1. If the parties live in the same city, personal relationship shall be maintained between the child in common and the father on every week starting from every Friday afternoon through Saturday afternoon.
    2. If in the future the mother PLEASE ENTER YOUR NAME IN FULL decides to live in different city/country with the best endeavours she agrees to serve as much notice minimum or not less than two months, in such case personal relationship shall be maintained between the child in common and the father on the second week of every two months for approximately 3-5 days as of the enactment of this Uncontested Divorce Protocol. During this period, the father may take the child on holiday out of the city / country or spend time during the day and bring the child to the mother in the evening, this is shall be agreed mutually.
    3. Both Parties are agreed to sign the relevant forms that may be requested for travelling alone with, child in common, PLEASE ENTER YOUR CHILD’S NAME IN FULL for the benefit of the relevant authorities.
  6. Both parties has taken all their personal belongings from the joint marital home. All house furniture and white goods in the joint marital home are left to PLEASE ENTER HIS/HER NAME IN FULL’s possession. PLEASE ENTER HIS/HER NAME IN FULL has taken all his/her jewellery. Both parties have released each other regarding their personal belongings.
  7. The joint marital home that parties used to live in during their marriage registered at PLEASE ENTER FULL ADDRESS OF THE JOINT MARITAL HOME is left to PLEASE ENTER HIS/HER NAME IN FULL’s possession.
  8. PLEASE ENTER HIS/HER NAME IN FULL agrees to pay ….00TL as Material and ….00TL as Moral Indemnity for the benefit of PLEASE ENTER HIS/HER NAME IN FULL to the following account: PLEASE ENTER BANK ACCOUNT DETAILS. This payment shall be one and only payment and done simultaneously with the application to the court.
  9. Parties agreed to share court fees equally between themselves, and each party shall b e responsible for their attorneys’ fees.
  10. This document with its 10 articles contains the entire agreement between the parties regarding their DIVORCE SETTLEMENT, and Parties have jointly read executed and delivered this Agreement as of the date indicated below in three (3) original copies. …/…/…..
